Aiming at respect for our clients, compliance with the General Data Protection Law - LGPD (Law No. 13,709/2018), and the best practices in the market, RPZ Advogados informs that it has finalized the process of implementing its Privacy Program, based on international standards and with the assistance of specialized advice.

The LGPD, approved in August 2018 by the then president Michel Temer, should take effect on August 14 of this year, however, after the provisional measure (MP 959/2020) issued in April 2020 suggesting its delay, the start of validity of the LGPD was pending until yesterday.

When voting on Conversion Bill 34/2020, derived from MP 959 of 2020, the Federal Senate decided to maintain the provisions of Law 14,010/2020 and the validity of the LGPD as of August 14, 2020 with sanctions for non-compliance with the law starting in August of next year.

Inspired by European Union regulations, General Data Protection Regulation - GDPR, the main function of the LGPD is to regulate the processing of personal data of Brazilian citizens, guaranteeing their rights and giving holders tools to question the use of their data.

Despite all this climate of uncertainty regarding the beginning of its validity, the LGPD is already a reality in Brazil, especially today 27/08, after the publication of the decree creating the National Data Protection Authority (ANPD), the body that will oversee compliance with the LGPD. This is undoubtedly a topic that is in great evidence in the current market, since it creates a legal framework for the protection of personal data in Brazil. The legislation is quite extensive and provides for considerable penalties for those who do not comply.
